1. Acceptance of Terms
By accessing and using the Lqorpqpkr platform, you accept these Terms and Conditions in full. If you do not agree with any part of these terms, you should not use our services. Lqorpqpkr reserves the right to modify these terms at any time, notifying registered users of substantial changes.
2. Service Description
Lqorpqpkr operates a real estate crowdlending platform that connects investors with real estate development projects in Ecuador. We are not a financial institution or a bank. We act as technological intermediaries between investors and real estate developers.
3. Eligibility Requirements
To use our services, you must: be at least 18 years of age; be an Ecuadorian citizen or legal resident with a valid identification card; have legal capacity to enter into binding contracts; not be included on national or international sanctions lists.
4. Registration and Account
You must provide truthful, complete, and up-to-date information during registration. You are responsible for maintaining the confidentiality of your access credentials. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or close accounts that violate these terms.
5. Investments and Risks
Investments in real estate crowdlending carry inherent risks, including: partial or total loss of invested capital; delays in real estate projects; fluctuations in the Ecuadorian real estate market; risk of default by developers. Past returns do not guarantee future results. You should only invest funds that you can afford to lose.
6. User Obligations
You agree to: use the platform only for lawful purposes; not attempt unauthorized access to our systems; provide source of funds documentation when required; comply with all applicable tax laws in Ecuador; not use the platform for money laundering or other illegal activities.
7. Intellectual Property
All content on the platform, including texts, graphics, logos, images, and software, is owned by Lqorpqpkr or its licensors and is protected by Ecuadorian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without express authorization.
8. Limitation of Liability
Lqorpqpkr does not guarantee specific investment returns. We are not responsible for: investment decisions made by users; actions or omissions of real estate developers; service interruptions due to force majeure; losses arising from use of the platform.
9. Dispute Resolution
Any dispute related to these terms will be submitted to the jurisdiction of the competent courts of the city of Quito, Ecuador. Before initiating legal action, the parties agree to attempt to resolve disputes through direct negotiation or mediation.
10. Applicable Law
These Terms and Conditions are governed by the laws of the Republic of Ecuador, including but not limited to: Ecuador's Civil Code, Electronic Commerce Law, Organic Law on Personal Data Protection, and regulations of the Superintendency of Companies, Securities, and Insurance.
